House Bill 562 extends the advance notice periods insurers must provide before canceling or non-renewing commercial property, commercial liability, commercial multiperil, and fire insurance policies in Idaho. For commercial insurance under Section 41-1842, the cancellation notice period for reasons other than nonpayment of premium increases from 30 days to 60 days, and the nonrenewal notice period increases from 45 days to 60 days. If a nonrenewal notice is mailed fewer than 60 days before expiration, coverage automatically extends until 60 days after the notice is sent.
For fire insurance policies under Section 41-2401, the bill raises the cancellation notice requirement from 30 days to 60 days and adds a new explicit requirement that the cancellation notice be accompanied by the reason for cancellation. The bill also creates a new standalone subsection (k) requiring fire policies to include a 60-day nonrenewal notice with the reason stated, along with the same coverage-extension provision if notice is late. Previously, fire policy nonrenewal notice requirements were less clearly defined in statute.
The bill removes references to ‘notice of intention not to renew’ from the proof-of-mailing provision for fire policies, replacing that function with the new dedicated nonrenewal subsection. All changes take effect January 1, 2027, and apply only to policies with coverage effective dates after that date.
