Bill Information: H0838 – Executive Budget Transparency Requirements
Bill Summary
House Bill 838 amends Idaho Code Section 67-3507 to impose new disclosure requirements on the governor’s executive budget document. Specifically, when the governor’s budget includes a recommendation that requires the legislature to pass new legislation, the budget document must now include a complete draft of that legislation along with the names of at least one House member and one Senate member who have agreed to sponsor it. When a budget recommendation requires the legislature to adopt conditions, limitations, and restrictions language, the budget must also include a draft of that language.
The bill also makes technical restructuring changes to the existing statute, converting the four numbered parts of the executive budget document from standalone numbered sections into lettered subsections under a new subsection, and correcting a capitalization error. These changes are purely organizational and do not alter the substantive content requirements of the existing budget document parts. The bill is declared an emergency measure, taking effect July 1, 2026, at the start of the next fiscal year.
Overall Assessment
House Bill 838 is a procedural and administrative reform focused on the mechanics of Idaho’s executive budget process and the working relationship between the governor’s office and the legislature. The bill does not address any of the substantive policy areas covered by the evaluation metrics, which range from agriculture and water to education, health and welfare, and law and order. Its scope is limited entirely to how budget recommendations are formatted and documented when they require legislative action.
Because the bill contains no provisions that advance, hinder, or otherwise relate to any of the nineteen policy articles used in this evaluation, every metric received a score of zero. The bill’s impact is confined to improving the procedural clarity and actionability of the executive budget document, which, while potentially beneficial for governmental efficiency, does not intersect with the substantive policy priorities measured by these criteria.
