Violations carry civil penalties of up to $250 for individuals and up to $2,500 for entities, with a two-year statute of limitations and enforcement authority vested in the Attorney General or appropriate prosecuting attorney.

The bill also requires that when a prohibited ex parte communication is received, the commissioner or employee must create a written summary within seven business days, place it in the commission record, and transmit a copy to any adverse party in the proceeding. Exceptions exist for purely ministerial or scheduling matters and for statements made in duly noticed public hearings.
